1. Acceptance of Terms
By purchasing, activating, or using any service provided by IT Storm Technology Inc. (“IT Storm“, “we“, “us“), you agree to be bound by these Terms of Service (“Terms“). If you do not agree, do not use our services.
2. Services
IT Storm provides managed web hosting, domain registration, managed IT services, and related technical services to businesses and individuals. The specific services applicable to your account are described in your order confirmation.
3. Payment and Billing
All prices are in Canadian dollars (CAD) unless otherwise stated. Ontario HST (13%) applies to all services. Invoices are generated at the start of each billing cycle and are due upon receipt. Overdue accounts may be suspended after 14 days and terminated after 30 days without further notice.
IT Storm accepts payment by credit card (Visa, Mastercard, American Express), PayPal, and Interac e-Transfer. Recurring billing is automatic for annual and biennial plans.
4. Late Fees and Collection
Accounts overdue by more than 30 days may be subject to a $25 CAD late fee. IT Storm reserves the right to engage a collection agency for accounts overdue by more than 60 days. You are responsible for all reasonable costs of collection.
5. Account Suspension and Termination
IT Storm may suspend or terminate your account without notice for: (a) non-payment; (b) violation of the Acceptable Use Policy; (c) activity that places undue burden on shared infrastructure; or (d) any other material breach of these Terms. Upon termination, you forfeit access to all hosted data. IT Storm is not liable for data loss resulting from termination for cause.
6. Account Cancellation
You may cancel your account at any time by submitting a cancellation request through the client portal or by contacting [email protected]. Cancellations take effect at the end of the current billing period unless you request immediate cancellation. Monthly plans are non-refundable after the first 30 days. Annual and biennial plans are subject to the Refund Policy.
7. Data Retention After Cancellation
Upon account cancellation or termination, IT Storm retains your data for 30 calendar days. After this period, all data, including websites, databases, email, and backups, is permanently deleted. It is your responsibility to download and retain copies of your data before or during the 30-day window.
8. Service Level and Uptime
IT Storm commits to 99.9% monthly uptime on shared hosting services. Details of credits for downtime below this threshold are set out in the Service Level Agreement. Uptime credits are the sole remedy for service unavailability and do not include consequential damages.
9. Acceptable Use
Your use of IT Storm services is subject to the Acceptable Use Policy (“AUP”), which is incorporated into these Terms by reference. Violation of the AUP is grounds for immediate suspension.
10. Intellectual Property
You retain ownership of all content you upload to IT Storm servers. By using our services, you grant IT Storm a limited, non-exclusive licence to host, transmit, and back up your content solely for the purpose of providing the contracted services.
11. Limitation of Liability
To the maximum extent permitted by applicable law, IT Storm’s total liability to you for any claim arising from or relating to these Terms or the services shall not exceed the total fees paid by you to IT Storm in the three (3) months immediately preceding the claim. IT Storm is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption, even if advised of the possibility of such damages.
12. Modifications to Terms
IT Storm may modify these Terms at any time by posting an updated version to this page and providing at least 30 days’ notice to your account email. Continued use of the services after the effective date constitutes acceptance of the modified Terms.
13. Dispute Resolution
Any dispute arising from or relating to these Terms shall be resolved by the courts of the Province of Ontario, Canada. You consent to the exclusive jurisdiction of the courts of Ontario for this purpose.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.
